What to Do After a Motorcycle Accident
Motorcycle accidents can be particularly devastating due to the lack of protection riders have compared to those in passenger vehicles. If you’re a motorcyclist in Nebraska, it’s essential to know what steps to take in the event of an accident. This not only protects yourself physically but preservers any potential legal claims you might have. Here’s a step-by-step guide.
- Call 911 – Even if your injuries appear minor, it’s essential to contact the police and emergency services. The report that responding officers take can be a valuable piece of evidence if you decide to pursue a claim.
- Document the Scene – If possible, take photographs of the accident scene. Include your motorcycle, any vehicles involved, road conditions, traffic signals, and skid marks. This can provide a clear picture of what happened and who might be at fault.
- Exchange Information – Collect the names, addresses, phone numbers, insurance details, and license plate numbers of all involved parties and witnesses.
- Do Not Admit Fault – While you might feel the urge to apologize or make statements about the accident, refrain from doing so. Insurance adjusters and defense teams could use anything you say in the heat of the moment against you later.
- Seek Medical Attention – Don’t decline medical attention at the scene, even if you feel okay. Some injuries may not manifest symptoms immediately. Follow up with your doctor or visit a hospital to be safe.
- Notify Your Insurance Provider – Inform your insurance provider about the accident as soon as possible. Failure to do so could jeopardize your insurance coverage. However, be cautious in your discussions and avoid making definitive statements without consulting with an attorney.
- Maintain Records – Save all documents related to the accident. This includes medical bills, repair estimates, receipts for any out-of-pocket expenses, and any correspondence with insurance companies.
- Follow Through with Medical Treatments – Adhere to your doctor’s treatment plan, which could include prescription medications, follow-up care, and physical or occupational rehabilitation. This not only aids your recovery but also documents the severity and ongoing nature of your injuries.
- Consult with a Personal Injury Lawyer – If you believe the other party was at fault, or the insurance company gives you a hard time, consult with a personal injury lawyer who handles motorcycle accidents. They can review your case, advise you on your legal options, and even pursue your claim on your behalf.
